The Commission: The Artist, Melinda Butler of the Unrolled Canvas LLC agrees to create an original painting based on the size, general color palette, subject or inspiration, and other details agreed upon with the Client. Each commissioned painting is an original work of art. While a commission may be inspired by an existing piece in my portfolio, it will not be an exact reproduction.
Artistic Discretion: By commissioning an original painting, the Client acknowledges that they are hiring the Artist for her established style and creative interpretation. Reference images, existing paintings, color palettes, and other inspiration may be used as a starting point, but the final artwork will reflect the Artist's individual creative process. Compostion, brushwork, color placement, texture, and other artistic decisions may evolve as the painting is created. Variations are part of the nature of original, handmade artwork and are what make each piece one of a kind.
Payment: A 50% non-refundable deposit is required to reserve the commission and begin work. The remaining 50% is due upon completion and approval of the artwork and before the painting is shipped or delivered. The artwork remains the property of The Unrolled Canvas LLC until payment has been made in full.
Timeline: Estimated completion time will be discussed before work begins. Completion dates are estimates rather than guaranteed delivery dates unless otherwise agreed upon in writing. Oil paintings require additional time to cure before they can be safely varnished, framed, packaged, or shipped. Depending on the painting, this may add several weeks after completion. The Artist will communicate any significant changes to the anticipated timeline.
Changes & Revisions: The Client is encouraged to communicated important preferences before painting begins. Because commissioned artwork is created through an organic artistic process, major changes cannot always be made once painting is underway. Reasonalbe minor adjustments may be made at the Artist's discretion. Significant changes, changes to the original agreed-upon direction, or requests requiring substantial repainting may result in an additional fee.
Cancellation: The initial 50% deposit is non-refundable once the commission has been reserved. If the Client chooses to cancel after work has begun, the deposit will be retained by the Artist to compensate for time, materials, and the reserved commission space. If the Artist is unable to complete the commission, payments made toward the unfinished artwork will be refunded.
Shipping and Delivery: Shipping, local delivery, or pickup arrangements will be determined before the artwork is delivered. Any applicable shipping charges will be communicated to the Client. The Artist will carefully package the artwork for shipment. The Client is responsible for providing an accurate shipping address. Any damage occurring during shipment should be reported to the Artist promptly, along with photographs of the artwork and packaging, so that the Artist can assist with resolving the issue.
Copyright & Reproduction: The purchase of an original painting transfers ownership of the physical artwork only. The Artist retains all copyrights and reproduction rights to the artwork, including the right to photograph, display, publish, reproduce, sell prints or other reproductions, and use images of the artwork for portfolio, website, social media, advertising, promotional, and other business purposes. The Client may display and photograph the purchased artwork for personal, non-commercial purposes. The artwork may not be reproduced, commercially distributed, altered for commercial use, used to create merchanise or other products without written permission from the Artist. The Client may not upload their commission to any AI entities in any capacity.
Originality: Every commissioned painting is individually created by hand. Because the Artist may revisit similar subjects, palettes, techniques, or themes throughout her body of work, commissioning a painting does not grant exclusivity over a particular color palette, subject matter, composition style, technique, or artistic concept. The commissioned physical painting itself will remain an original, one-of-a-kind artwork.
Agreement: By purchasing this commission, the Client confirms that they have reviewed and agree to the terms above and authorize The Unrolled Canvas LLC to begin creating the commissioned artwork upon receipt of the required deposit.
